Terms of use

1. The short version

This website is published information about a product that is still being built. Reading it does not enrol you in anything, does not create an account, does not form a contract to buy anything, and does not give you access to the private environment described on it.

BBA Trading is not a broker, not an exchange and not an investment adviser. Nothing on this website is investment, financial, legal or tax advice, or a recommendation to trade anything. Everything the product does is simulated.

2. Who these terms are between

“BBA Trading”, “we” and “us” mean BBA Trading, a division of BBA Network. “You” means anyone who opens this website.

These terms apply to this website only — the pages served at trade.bbanetwork.org. The private evaluation environment is separate, is not reachable from here, and carries its own terms which are given to a participant before they are given access. Nothing in this document grants or describes a right to that environment.

3. Accepting these terms

There is no button to click, because there is nothing on this website that would need one. By using this website you accept these terms; if you do not accept them, the remedy is to close the page, and you lose nothing by doing so.

If these terms ever have to be agreed to rather than merely read — because there is something to sign up for or something to pay for — that will be an explicit step at the time, not a change quietly made here.

4. What this website is not

To be explicit, because businesses in this category are frequently mistaken for businesses that are regulated: BBA Trading does not do, and this website does not offer, any of the following.

• No brokerage, dealing or execution — no order ever leaves the environment
• No access to a market, an exchange, live prices or real market data
• No investment, financial, legal, tax or trading advice, and no recommendation
• No managed accounts, no pooled funds, no custody, and no holding of anyone’s money
• No copy trading and no trading signals
• No real-money trading of any kind, in any form, anywhere in the system

No part of this is planned-but-not-yet-built. There is no mechanism in the software for any of it, and adding one would require legal, accounting, payment and vendor review that has not taken place.

5. Prices shown on this website are not an offer to sell

This website shows the prices we intend to charge for a simulated evaluation when enrolment opens. Enrolment is not open. There is no checkout on this website, no payment processor is connected to it, and no payment can be taken through it.

The prices are information, not an offer capable of acceptance, and they may change before anything is sold. Pressing a price does nothing: those controls are disabled, which the page states beside them.

Before enrolment ever opens, separate terms of sale will be published covering what is being bought, how billing works, how to cancel, and what is refundable. Until those exist, nothing on this website can create a payment obligation, because nothing on this website can take a payment.

6. Simulated results are not real results

Everything the evaluation environment produces is simulated. Balances are invented, trades are recorded rather than placed, and results are computed by our own rules engine against an invented account.

Simulated performance has inherent limitations that real trading does not. It is prepared with the benefit of hindsight over data the simulation controls, it bears none of the financial risk of real trading, and it does not reproduce market liquidity, slippage, execution delay, fees, financing, outages or the effect of an order on the market it is placed into.

No simulated result is a prediction or an indication of what would have happened, or would happen, in a real market. We make no representation that any result is achievable, and we guarantee no outcome of any kind.

7. Eligibility

This website is not directed at anyone under 18, and the private environment is not open to anyone under 18.

There is nothing to be eligible for yet: access to the private environment is by invitation, is granted at our discretion, and no one has a right to it. If eligibility requirements apply to enrolment when it opens, they will be stated before anyone is asked for anything.

8. How you may use this website

You may read it, link to it, and quote it accurately with attribution. What you may not do is narrow, and all of it is about not breaking the site or misrepresenting it:

• Do not attempt to breach, probe, overload or disrupt this website or the systems serving it, or to reach any non-public part of them
• Do not use this website to break the law, or to help anyone else do so
• Do not reproduce it as your own, or present our words, brand or rules as somebody else’s product
• Do not misquote it — particularly not in a way that suggests we are live, regulated, approved, a broker, or able to take money
• Do not scrape it at a rate that degrades it for anyone else

The last one is deliberately about behaviour rather than about tools. We publish this page to be read, including by machines that summarise it, and a rule against automated reading would be a rule we did not mean.

9. The private environment

Access to the private evaluation environment is granted by us, to specific people, for testing. It is protected by a sign-in wall and is not reachable from this website — there is deliberately no link to it anywhere on this site.

Where access is granted it may be changed, suspended or withdrawn at any time, and the environment itself may be reset, rebuilt or taken down. It is a test system. Nothing in it is a record of value, and nothing in it is owed to anyone.

Attempting to reach it without being given access is not permitted, and is covered by the section above.

10. Rules and ruleset versions

The evaluation is graded by a published ruleset. Rulesets are versioned, and an account is graded by the version it opened under for as long as it is open. A new version applies to new accounts only.

That is a commitment about our own conduct, and it is written into the software rather than into this page: the version is recorded on the account when it is opened, and grading reads that version rather than the latest one. We state it here so it is on the record as a term and not only as an implementation detail.

The rules published on this website may change before enrolment opens, because the product is still being built. What will not happen is a change being applied backwards to an account already running under an earlier version.

11. Our content and our brand

This website, its text, its design, the BBA Trading name and mark, and the rules engine behind the product, are ours and remain ours. Nothing here transfers a licence to reuse them beyond accurate quotation with attribution.

If you believe something on this website infringes your rights, tell us at the address below and we will look at it. We would rather hear from you than from anyone else.

12. Availability, and no warranty

This website is provided as it is. We do not promise it will be available, uninterrupted or error-free, and we may change or withdraw any part of it at any time without notice. It describes a product in development, and the product may change or may never be released.

We try hard to make every figure on this website accurate — the evaluation numbers are generated from the rules engine itself for that reason — but we do not warrant that everything here is complete, current or free of error. Where something here is wrong, tell us and we will correct it.

13. Liability

Because this website sells nothing, takes nothing and holds nothing of yours, there is very little it can cost you. To the extent the law allows, we are not liable for loss arising from your use of this website, from reliance on information published on it, or from it being unavailable.

Nothing in these terms limits liability that cannot lawfully be limited — including for fraud or for fraudulent misrepresentation — and we are not attempting to limit it.

This section is deliberately short. Expansive limitation and indemnity clauses are written to protect a business from the transactions it conducts, and we conduct none. When there is something to buy, this will be replaced by a version written with proper advice.

14. Links to other websites

This website links to almost nothing outside itself. Your browser does fetch two typefaces from Google when the page loads, which is described in the privacy notice. Where a link to another website appears, that website is not ours and we are not responsible for it.

15. Disputes, and the law that applies

These terms do not choose a governing law, do not require arbitration and do not waive anyone’s right to bring or join a class action. That is not an oversight. Those clauses are the ones that most affect a reader, and they will be settled with legal advice before this website can sell anything — not by copying them from another company.

Until then, whatever rights you have under the law where you live, you keep. If you have a problem with something here, the first step is to tell us, and the address is below.

16. Changes to these terms

If these terms change, the revised version will be posted on this page with a new date at the top. Because the product is in private development, the likely change is that they grow: if enrolment, payment or public sign-up is ever added, these terms will say so before it is switched on, and terms of sale will be published alongside them.
